By accessing or using BoingyBooks ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
BoingyBooks is operated by BooksAndGuidesPro ("Company", "we", "us", or "our"). These Terms apply to all visitors, users, and others who access or use the Service.

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.
You retain ownership of all content you create and upload to BoingyBooks, including text, images, and audio ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as necessary to provide the Service.

Given that BoingyBooks is designed for creating children's educational content, all published content must be appropriate for children of all ages unless specifically marked otherwise.
Sellers must complete our seller onboarding process, which includes identity verification through Stripe Connect. Sellers are responsible for pricing their books within our fixed price tiers.
We charge a 10% platform fee on all marketplace sales. Payment processing fees (Stripe fees) are absorbed by the platform and not deducted from seller payouts.
Seller payouts are processed automatically through Stripe Connect according to Stripe's payout schedule. We are not responsible for delays caused by Stripe or banking institutions.
Refund requests are handled on a case-by-case basis. Digital products are generally non-refundable unless there is a technical issue preventing access to the purchased content.
The Service and its original content (excluding User Content), features, and functionality are owned by BooksAndGuidesPro and are protected by copyright, trademark, and other intellectual property laws.
You represent and warrant that you have all necessary rights to the content you upload, including text, images, and audio. You are solely responsible for ensuring your content does not infringe on third-party rights.
Different subscription plans have different limits on the number of books you can create, storage space, and features available. These limits are enforced automatically by the system. Exceeding plan limits may require upgrading to a higher plan.
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your personal information.
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
We do not endorse or guarantee the accuracy, completeness, or usefulness of any User Content. Your use of any User Content is at your own risk.
To the maximum extent permitted by law, BooksAndGuidesPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
You agree to indemnify and hold harmless BooksAndGuidesPro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
